租賃屋頂安裝光伏:農(nóng)村光伏租賃屋頂要注意什么?
1、產(chǎn)權(quán)歸屬問(wèn)題:根據(jù)《城鄉(xiāng)規(guī)劃法》規(guī)定:未取得建設(shè)工程規(guī)劃許可證或者未按照建設(shè)工程規(guī)劃許可證的規(guī)定進(jìn)行建設(shè)的建筑、房屋、構(gòu)筑物,屬于違章建筑,縣級(jí)以上城鄉(xiāng)規(guī)劃部門,有權(quán)要求限期拆除,沒收實(shí)物或違法收入,并處罰款。在進(jìn)行租賃前期,為避免后續(xù)的一些麻煩和可能造成的損失,首先應(yīng)當(dāng)對(duì)房屋的情況進(jìn)行調(diào)查。房屋建設(shè)是否合規(guī),是否具有建設(shè)規(guī)劃許可證、竣工驗(yàn)收證明、消防驗(yàn)收證明和房屋產(chǎn)權(quán)證明,是否存在抵押、查封等情況。如若情況不明,在租賃時(shí)應(yīng)當(dāng)謹(jǐn)慎,盡量規(guī)避風(fēng)險(xiǎn)和后期不必要的糾紛。

2、屋頂使用問(wèn)題:在租用前,承租方應(yīng)該對(duì)房屋屋頂結(jié)構(gòu)以及防水等問(wèn)題進(jìn)行勘察評(píng)估,并簽訂書面租賃合同,約定租賃期限、租賃用途、租賃價(jià)格和損壞修繕等條款,并向房產(chǎn)管理部門備案,以避免在光伏電站建設(shè)和運(yùn)行過(guò)程當(dāng)中產(chǎn)生不必要的麻煩和糾紛。
2. 3. 4、政府征收拆遷補(bǔ)償問(wèn)題:根據(jù)《國(guó)有土地上房屋征收與補(bǔ)償條例》規(guī)定,政府征收拆遷停產(chǎn)停業(yè)補(bǔ)償對(duì)象是被征收人,也就是房屋產(chǎn)權(quán)所有人,租用方不能直接向政府索要賠償。光伏電站依附于房屋建筑,國(guó)家對(duì)房屋進(jìn)行征收和拆遷,因此停產(chǎn)停業(yè)損失補(bǔ)償應(yīng)該包括光伏電站停產(chǎn)的損失補(bǔ)償,但光伏電站應(yīng)該證明其自身存在經(jīng)營(yíng)行為,具有營(yíng)業(yè)執(zhí)照和相關(guān)手續(xù),以證明該項(xiàng)目和經(jīng)營(yíng)的合法性,同時(shí)還需要證明光伏電站的價(jià)值,以及現(xiàn)有和未來(lái)的收益情況。再有需要解決的就是補(bǔ)償?shù)轿缓?,出租方和承租方如何進(jìn)行分配的問(wèn)題。
4. The issue of compensation for government expropriation and demolition: According to the Regulations on the Expropriation and Compensation of Buildings on State owned Land, the compensation object for government expropriation, demolition, production and business suspension is the expropriated person, which is the owner of the property rights of the house. The lessee cannot directly demand compensation from the government. Photovoltaic power stations are attached to buildings, and the state expropriates and demolishes buildings.
